Terms of use

Last updated — [to be completed]

This text explains how InkFlow works and how data is processed. It is not legal advice.

The service

InkFlow is published by [to be completed], [to be completed] (contact: [to be completed]). It provides management tools (calendar, clients, projects, requests, messaging, finances, public page) for tattoo artists and their clients.

Account

You are responsible for keeping your credentials confidential and for the information entered in your account. The information you provide at sign-up must be accurate. Tell us without delay if your account is used without authorisation.

Acceptable use

  • Do not use the service for unlawful purposes or to harass others.
  • Obtain your clients' consent to the processing of their data where the law requires it.
  • Do not try to access other users' data, bypass security measures or overload the service.
  • Do not upload unlawful content or content you do not hold the rights to.

Your clients' data

You are the controller of your clients' data that you enter in InkFlow (see the privacy policy): informing people, legal basis, explicit consent for health data, compliance with the rules specific to your activity (minimum age, hygiene, studio registration…).

The document templates provided by InkFlow are indicative and are not legal advice: it is up to you to adapt them to your situation and your country.

Plans and payment

The Free plan is available with no time limit. The paid Pro and Studio plans are shown for information on the home page (prices in Swiss francs, excluding taxes). The Studio plan is not available yet and online payment of subscriptions is not enabled yet.

Billing terms (final prices, taxes, trial, refunds, cancellation) will be set out before any billing starts.

Deposits and payments between artists and clients

Deposits and payments are agreed between the artist and their client. InkFlow is not a party to that contract and takes no commission on these payments. As long as online payment is not enabled, InkFlow neither collects nor holds any funds: it displays the payment methods that the artist has entered themselves (TWINT, bank transfer, PayPal…). The artist remains responsible for the accuracy of this information and for confirming that the payment was received.

When a payment provider such as Stripe is enabled, its own terms will also apply.

Content and intellectual property

You keep your rights over the content you publish (photos, texts, portfolio) and grant us only the right to host and display it in order to provide the service. You warrant that you hold the necessary rights, including your clients' image rights when you publish their tattoos. InkFlow, its brand and its software remain the property of the publisher.

Availability

We aim for good availability but cannot guarantee that the service will be uninterrupted or error-free (maintenance, a provider incident). Keep the information that is essential to your business on your side as well.

Liability

The service is provided “as is”. Contracts and health instructions between artists and clients are their sole responsibility. To the extent permitted by the applicable law, the publisher's liability for indirect damages is excluded; mandatory consumer rights are reserved.

Termination

You can close your account at any time and request an export of your data. We may suspend an account that is used in breach of these terms.

Changes, governing law and contact

We may change these terms; significant changes will be communicated to you. Governing law and venue: [to be completed]. For any question: [to be completed].
